On 30 October 2017, the President of Ukraine signed the Law of Ukraine “On Ratification of Protocols No. 15 and 16 to the Convention for the Protection of Human Rights and Fundamental Freedoms” dated 05.10.2017, which granted legal force to two international legal instruments.
Thus, according to the ratified Protocol No. 15, the term for application to the European Court of Human Rights is reduced from six months to four after the date of the final decision at the national level.
At the same time, the Protocol No. 16, which also introduced by this Law, provided the possibility for the Supreme Court of Ukraine
The law will come into force on November 11, 2017.
The implementation of these Protocols significantly lighten the load of the European Court of Human Rights and at the same time, it will provide the opportunity for legal entities and individuals to obtain a legitimate and lawful decision that are fully in line with the Convention, already under consideration of the case in the Supreme Court without reference to European institutions.
