Act of the week: Banks Going On The Offensive. The analysis of the Draft Law No. 6027
For the past years, the category of bank disputes has been occupying leading positions in the context of cases brought to courts - both in terms of the quantitative indicator and the size of claims. Undoubtedly, deterioration of the economic situation in the country is one of the main reasons for such tendencies. However, one should not forget that imperfection, and in some cases, even the contradictory nature of the current banking legislation provides for a certain legal manipulation.
Judicial practice has already given the answers to many controversial issues. At the same time, there is not so much legislative work in this field. Nowadays one of the most discussed is the Draft Law "On Amendments to Certain Legislative Acts of Ukraine on Increasing Trust between Banks and their Customers" dated February 3, 2017 No. 6027 (hereinafter - Draft Law). The Draft Law is aimed at explicit protection of banks' interests in disputes with debtors, it accumulates the main tendencies of judicial practice in banking disputes.
